TITLE OF BILL: An act to amend the labor law, in relation to
providing that specifications and contracts for public work shall
contain a provision that laborers, workers, and mechanics shall be
certified as having completed a course in construction safety and
health approved by OSHA that is at least ten hours in duration
PURPOSE OR GENERAL IDEA OF BILL: The bill requires specifications and
contracts for public work in certain situations to contain provisions
requiring workers to be certified as having completed OSHA`s 10 hour
safety course prior to performing any work performed on the project.
SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends the
labor law by adding a new section 220-h, which requires specifications
and contracts for public work, where the total cost of all work
performed under the contract is at least two hundred fifty thousand
dollars, to contain provisions requiring workers to be certified as
having completed OSHA`s 10 hour safety course prior to performing any
work on the project.
Section 2 of the bill provides the department of labor with authority
to enforce this law.
Section 3 is the effective date.
JUSTIFICATION: This bill will improve the general safety and health of
all laborers, workers, and mechanics by directing them to take OSHA`s
ten hour course. The ten hour course will provide these employees with
the proper safety methods to be used during construction,
reconstruction, maintenance and repair of public work. It is the basis
of the bill that accidents on the job site will decrease when
employees are aware and administer the proper safety measures during
the course of their work.
